Governor Signs 6 Gun Control Measures in New Jersey

—Require a mental health professionals to warn law enforcement if a patient threatens serious violence against themselves or others

—Allow for an extreme risk protective order if a court deems someone poses a significant danger to themselves or others. The temporary court order bars the subject from possessing or purchasing a firearm or ammunition.

—Require background checks for private gun sales

—Lower the magazine capacity from 15 rounds to 10, with an exception for a popular .22-caliber rifle.

—Require residents to show a "justifiable need" to get a carry permit.

—Prohibit body-armor-penetrating ammunition.

While the legislation has earned the praise of gun control advocates, including Moms Demand Action for Gun Sense, who attended the bill-signing wearing bright-red T-shirts, it also has merited scorn from gun rights advocates who say the measure won't increase safety.

"None of the bills signed today will make anyone safer," said Scott Bach, executive director of the Association of New Jersey Rifle and Pistol Clubs, said in a statement. He said lawmakers have limited residents' ability to defend themselves while missing an opportunity to make schools safer and prevent those with mental health issues from acquiring firearms in the first place.

The group has filed a lawsuit seeking to overturn the limit of 10 rounds, claiming it would be ignored by "criminals and madmen."

The gun confiscation/control movement have shifted their focus to the States.  Gun controllers are using ambitious politicians to ram through gun confiscation.

New Jersey – -(AmmoLand.com)- September 28, 2018. A U.S. District Judge today refused to issue a preliminary injunction, or an injunction pending appeal, halting enforcement of New Jersey’s magazine ban enacted in June. See a copy of that legal decision here.

However, the district court’s decision is not the last word on the matter. Association of New Jersey Rifle and Pistol Clubs counsel were ready for the contingency and have already filed a notice of appeal, and they anticipate filing the papers Monday seeking an expedited decision halting the law during the appeal.

Despite finding that the banned magazines are “in common use,” the district court in its decision disregarded the Supreme Court’s clear command in Heller that such arms may not be banned.

The court decided that the magazine ban does not “substantially affect [individuals’] ability to defend themselves” even though the Second Amendment does not permit a State to pick and choose which arms it deems sufficient for self-defense. The court then denied Plaintiffs’ Equal Protection claim, applying an improperly low Constitutional standard, and denied Plaintiff Takings claim, finding that requiring a person to spend substantial money on modification does not require compensation.

State governments usually hides the rates of non-compliance with laws.  It will probably take a year long legal battle before the official non-compliance rates are made available.

New Jersey's standard capacity magazine ban is now in effect making New Jersey's one million gun owners criminals in the eyes of the state. But in an act of mass definace, New Jersey residents refuse to comply.

Any magazine holding more than ten rounds is now illegal in the Garden State. The standard magazine for an AR-15 holds 30 rounds. Glock 19s, which is the most popular pistol in the United States, holds 15 rounds. Anyone who is possession of larger magazine is committing a fourth-degree felony.

Anyone caught with one of the now banned magazines in their possession faces up to 18 months in prison and up to $10,000 in fines or both for each magazine found.

The bill was signed into law last June by Gov. Phil Murphy (D). Residents had until December 11th, 2018, to turn over magazines to police or sell or store them out of state.

Pro-gun groups sued New Jersey to try to prevent the law from going into effect. Their attempt on blocking the law failed in a federal appeals court. The three-judge panel ruled that a law limiting the number of rounds a magazine holds did not violate the US Constitution and did not put an undue burden on New Jersey gun owners.
