Second Amendment Looms Over Supreme Court After Back-To-Back Massacres

The Supreme Court will encounter an array of Second Amendment issues in its upcoming term, after a pair of bloody weekend shootings left over 30 dead in a matter of hours.
The justices are currently slated to hear just one gun rights case at present, but decisions on other petitions could come by autumn.
Those disputes include state laws controlling the issuance of public carry licenses, and a lawsuit against a gun manufacturer.

The current case before the Supreme Court is  New York State Rifle & Pistol Association, Inc., et al., Petitioners v.  City of New York, New York, et al.   New York City and New York state has changed their transport law/regulation in an attempt to moot the case.

The Supreme Court is holding (have not agreed to hear yet)  Ivan Pena, et al., Petitioners v.  Martin Horan, Director, California Department of Justice Bureau of Firearms.  This case involves the ever shrinking handgun roster of available guns to purchase by people of California.

There are public carry licenses couple cases out of New Jersey which is a "we will not issue a carry license unless you are politically connected" state that some believe the Supreme Court might take up.

BuzzFeed News Los Angeles bureau chief Jon Passantino complained that Drudge was “giving the killer a massive platform to spread dangerous propaganda.”

This is strange coming from a journalist. Any such writings by a mass murderer are legitimate news, and besides, BuzzFeed had no problem linking to reports on crazed Los Angeles cop-killer Christopher Dorner’s manifesto back in 2013.

With many 2nd Amendment defenders rightly up in arms (no pun intended) over President Trump's previous comments on 'red flag' laws:

Is Donald J. Trump anti-gun rights? Some might say “yes,” because the president has joined with Senator Lindsey Graham (R-SC) to support “red-flag” laws that allow government agents to take guns temporarily from those deemed too dangerous or unfit to possess a weapon. Such laws may be a major threat to the Second Amendment unless great care is taken to ensure due process is observed strictly and fully.

Graham, in a statement, said he has reached a deal with Sen. Richard Blumenthal (D-CT) on a bill that would start a federal grant program to help and encourage states to create ‘”red flag” protection order’ laws, which are meant to make it easier for law enforcement to identify mentally ill people who should be banned from purchasing guns.”

Trump announced his support for the red-flag laws from the White House on Aug. 5, stating that “those judged to pose a great risk to public safety (should) not have access to firearms and that if they do, those firearms can be taken through rapid due process.”

The Federal Bureau of Investigation has quietly been searching for private contractors who could gather and feed to law enforcement tremendous amounts of user data straight from social media platforms such as Twitter, Facebook and Instagram.

The U.S. government needs “real-time access to a full range of social media exchanges” to better fight terrorist groups and domestic threats, the FBI said in its request for bids, which was first reported by the Wall Street Journal.

But the FBI’s effort to gain far-reaching visibility into the social media activities of both Americans and foreigners risks clashing with other parts of the federal government that have sought to clamp down on Silicon Valley for data breaches, privacy violations, and other cases in which user information was shared without consent.

The FBI’s search began in early July. It calls for providers that can give law enforcement agents advanced warning of violent incidents as well as the ability to summon a given social media user’s ID numbers, IP addresses and telephone numbers if necessary.

This is not the first time the FBI has sought access to a wide array of social media data. In 2016, the agency announced it had hired the social media analysis company Dataminr to allow law enforcement to “search the complete Twitter firehose, in near real-time, using customizable filters.” Dataminr, which looks at open source information only, is also contracted by media outlets including CNN.

Patrick Ryan, a congressional candidate from New York, is leaning on his experience as a small business entrepreneur to establish his readiness for office, but he has curiously failed to mention the business he used to work in: domestic surveillance.

Seven years ago, Ryan, then working at a firm called Berico Technologies, compiled a plan to create a real-time surveillance operation of left-wing groups and labor unions, hoping business lobbyists would pay top dollar to monitor and disrupt the actions of activist groups across the country. At one point, the proposal included the idea to spy on the families of high-profile Democratic activists and plant fake documents with labor unions in a bid to discredit them.

The pitch, a joint venture with a now-defunct company called HBGary Federal and the Peter Thiel-backed company Palantir Technologies, however, crumbled in 2011 after it was exposed in a series of news reports.

Years later, Ryan pivoted to a startup called Dataminr, a data analytics company that provided social media monitoring solutions for law enforcement clients. Dataminr, which received financial support from the CIA’s venture capital arm, produced real-time updates about activists for law enforcement. For example, according to documents obtained by the American Civil Liberties Union of California and reported by The Intercept for the first time, Dataminr helped track social media posts relating to Black Lives Matter.

Dataminr, a US technology company backed by an array of leading Wall Street investors and Twitter, is opening a Dublin office next month as part of its European expansion.

The firm is recruiting an initial team of up to 20 and is already hiring engineers and copy editors working in English, Russia and Arabic.

Steven Schwartz, president of commercial markets at Dataminr, told The Irish Times the company’s expansion into Ireland was spurred by the need to serve its growing number of European clients, as well as US clients with global operations.

“Dublin complements our expanding London office, and provides Dataminr with access to world class talent with a global perspective and a range of expertise – in finance, public sector, corporate security, journalism, engineering, and customer support.”

The company said Brexit and the expansion of a number of its largest clients in Dublin was not a factor in choosing to set up in Ireland.

Founded in 2009 by three former Yale roommates, the New York-based company’s client list includes most of the biggest US investment banks and at least half of the top hedge funds, overseeing a collective $1 trillion in assets.

Dataminr’s software scours Twitter and other social media platforms to identify potentially significant or market-moving events – such as a coup or an explosion at a utility plant – and then flags them for investment bank and hedge funds in real time.

As a series of recent mass shootings have brought renewed demands for the U.S. government to do something to address the spike in “lone wolf” violence, the Trump administration’s decision to blame internet privacy, controversial websites like 8chan, and social media for the shootings has raised eyebrows from across the political spectrum, particularly in light of claims that Trump’s recent rhetoric about immigrants may have incited some of the shooters.

During a press conference on Monday, Trump blamed the internet for the three most recent mass shooting events:

We must recognize that the internet has provided a dangerous avenue to radicalize disturbed minds and perform demented acts. We must shine light on the dark recesses of the internet and stop mass murders before they start…. The perils of the internet and social media cannot be ignored, and they will not be ignored… We cannot allow ourselves to feel powerless. We can and will stop this evil contagion.”

Yet, not long before the recent spate of mass shootings began, U.S. Attorney General William Barr gave a speech on July 23 in which he spoke of the need for all consumer electronic devices and encrypted software to have a backdoor for the government to bypass encryption, essentially calling for many of the same measures that Trump has proposed following the recent shootings.

Notably, Barr concluded his speech by stating that he anticipated “a major incident may well occur at any time that will galvanize public opinion on these issues.” In other words, just a few days prior to the recent spate of mass shootings, William Barr stated that he anticipated a public safety crisis that “may well occur at any time” and would reduce public resistance to the further erosion of civil liberties that he was advocating for in his speech.

Furthermore, the FBI, which operates under the jurisdiction of the Department of Justice and reports directly to William Barr, has now stated that it was aware of the El Paso shooter’s plan to murder civilians via a post made on 8chan at least two hours before the shooting took place. 8chan — a controversial website that the FBI is known to have used to incite violence as part of its controversial terrorist entrapment strategy — has since been banned in the shooting’s aftermath. In addition, less than two months ago, the FBI obtained a warrant for 8chan’s host — Ch.net — in which the Bureau demanded access to the entire contents of the accounts that were of interest in that specific investigation, suggesting that the FBI had increased access to information of hundreds of 8chan accounts in the lead-up to the recent shootings.

LOS ANGELES (AP) — Gilroy police have identified an additional person who suffered a gunshot wound — but narrowly escaped a more serious injury — during a deadly shooting at a famous garlic festival last month, authorities said.

Officials said a 58-year-old man sustained a graze wound to his head that required stitches. The man's injuries bring the total number of people shot during the July 28 shooting to 17. An additional three people — including two children — were shot and killed when Santino William Legan opened fire. Legan killed himself at the festival.

Gilroy Police Capt. Joseph Deras said the shooter was standing to the side of the 58-year-old man and "had he coughed or sneezed or just moved at all" sideways or backward, "that round would have just struck him square in the head."

Officials said Legan used a Romanian-made WASR-10 rifle, an AK-47-style firearm, that he had purchased in Nevada. Prentice Danner, an FBI spokesman in San Francisco, said Thursday the rifle previously came from Century Arms, a firearms manufacturer and importer based in Vermont and Florida.

The FBI has opened a domestic terrorism case and is continuing to investigate. Although authorities found a “target list” containing religious institutions, courthouses and other sites, they say they have not determined Legan’s motive.

GILROY, Calif. (AP) — Before a 19-year-old gunman opened fire on a famed garlic festival in his California hometown, he urged his Instagram followers to read a 19th century book popular with white supremacists on extremist websites, but his motives for killing two children and another young man were still a mystery Monday.

Santino William Legan posted the caption about the book "Might is Right" with a photo of Smokey the Bear in front of a "fire danger" sign. He posted another photo from the Gilroy Garlic Festival minutes before he shot into the crowd Sunday with an "AK-47-type" weapon, killing a 6-year-old boy, a 13-year-old girl and a recent college graduate.

Under it, he wrote: "Ayyy garlic festival time" and "Come get wasted on overpriced" items. Legan's since-deleted Instagram account says he is Italian and Iranian.

The postings are among the first details that have emerged about Legan since the shooting injured 12 others and sent people running and diving under tables. Police patrolling the event responded within a minute and killed Legan as he turned the weapon on them.

He legally purchased the gun this month in Nevada, where his last address is listed. He would have been barred from buying it in California, which restricts firearms purchases to people over 21. In Nevada, the limit is 18.

Legan grew up less than a mile from the park where the city known as the "Garlic Capital of the World" has held its three-day festival for four decades, attracting more than 100,000 people with music, food booths and cooking classes.

Authorities were searching for clues as to what caused the son of a prominent local family to go on such a rampage. His father was a competitive runner and coach, a brother was an accomplished young boxer and his grandfather had been a supervisor in Santa Clara County.

Police searched the two-story Legan family home and a dusty car parked out front, leaving with paper bags. Authorities also searched an apartment they believed Legan used this month in remote northern Nevada. Officials didn't say what they found or were looking for in either place.

A law enforcement official said investigators believe the gunman used a WASR-10, a variant of an AK-47, that he bought from Big Mikes Gun and Ammo in Nevada earlier this month. The official was not authorized to discuss an ongoing investigation and spoke to The Associated Press on condition of anonymity.

South Bay Lawmakers Seek Hate Crimes Task Force In Wake Of Gilroy Shooting

Local county and city legislators could soon gather a task force to combat and address hate crimes in Santa Clara County following deadly shootings throughout the country, including one at the Gilroy Garlic Festival in July.

The Santa Clara County Board of Supervisors voted Tuesday to act on a proposal from Supervisor Cindy Chavez to combat hate crimes in the county—something other local lawmakers are pushing for too.

“Once the Gilroy shootings occurred, it reminded me that sometimes I had been thinking that we were in a very safe space,” Chavez said. “I don’t think I fully appreciated that we were part of a very angry world with a very angry president that’s created an overlay of very angry people in our community.”

The board on Tuesday voted unanimously to move forward with the time-limited working group.

The task force will work on plans for preventing hate crimes, protecting women from hate crimes, coming up with recommendations to combat the illegal gun trade through law enforcement investments and recommend programs to implement in local schools to educate students on hate crimes and how to prevent them.

The task force will also work with law enforcement “to monitor the proliferation of hate speech,” according to Chavez’s memo to the board.
